ORDINANCE NO. 3/2026 DIRECTOR OF THE MUSEUM OF MODERN ART IN WARSAW DATED JANUARY 7, 2026 REGARDING THE ADOPTION OF THE RULES FOR USE OF THE LOCKER ROOMS AT THE DANCE AND OTHER PERFORMING ARTS PAVILION, LOCATED IN WARSAW AT 22 WYBRZEŻE KOŚCIUSZKOWSKIE STREET Pursuant to § 11, paragraph 4, item 6) of the Bylaws of the Museum of Modern Art in Warsaw, the following is hereby ordered: § 1 The Rules and Regulations for the use of the cloakroom at the Dance and Other Performing Arts Pavilion, located in Warsaw at 22 Wybrzeże Kościuszkowskie Street, are hereby established, as set forth in the attachment to this Order. § 2 This order takes effect on the date of its signing.
Rules for Using the Locker Room at the Dance and Other Performing Arts Pavilion, located in Warsaw at 22 Wybrzeże Kościuszkowskie Street Rules for Using the Cloakroom at the Pavilion of Dance and Other Performing Arts, located in Warsaw at 22 Wybrzeże Kościuszkowskie Street (hereinafter: “Rules”) set forth the rules for using the coat check made available to third parties (i.e., audience members and guests of the Pavilion of Dance and Other Performing Arts) by the Pavilion of Dance and Other Performing Arts in Warsaw at 22 Wybrzeże Kościuszkowskie Street(hereinafter: “the Pavilion”) and the storage therein of items left by such persons. § 1
The cloakroom is organized by the Museum of Modern Art in Warsaw—the Pavilion of Dance and Other Performing Arts.
The locker room is located on the ground floor of the Pavilion building and is staffed by Pavilion employees or associates.
The coat check opens no earlier than one hour before the start of a public performance and half an hour before other events held at the Pavilion, and closes once all outerwear or other items left there have been returned, but no later than half an hour after the end of the public performance or other event held at the Pavilion.
Except for the situations described in paragraph 3, the locker room is closed.
The Museum reserves the right to change the days and hours of operation of the Coat Check and to close the Coat Check on specific days and at specific times. The Museum shall not be held liable for exercising this right.
§ 2 § 3
The coat check accepts only the following items for storage:
1) outerwear; 2) umbrellas, handbags, and backpacks.
The coat check may or may not accept travel luggage for storage.
The coat check may accept items not listed in paragraphs 1–2 for storage; however, the coat check staff may refuse to accept a particular item, for example, if the storage area is full.
The decision to accept the aforementioned items is made on a case-by-case basis by the cloakroom staff.
§ 4 The coat check does not provide a deposit service for valuables and does not accept the following items for storage: 1) money, keys, documents; 2) jewelry and other valuables; 3) electronic equipment (e.g., computers, laptops, cell phones), photographic equipment, and other expensive specialized equipment; 4) items that could cause harm to third parties or their property, in particular through damage or contamination, as well as items that could damage or contaminate the locker room area; 5) foul-smelling, flammable, combustible, explosive, corrosive, or other hazardous materials, as well as animals, including, but not limited to, any pets in cages or containers. § 5
Leaving the items specified in § 4(t) in the Cloakroom—even without the knowledge of the Cloakroom staff—constitutes a flagrant violation of the Rules and Regulations.
These items will be immediately removed from the locker room, and anyone who leaves items prohibited by these Rules in the locker room will be asked to leave the Pavilion along with that item.
Anyone who leaves such items in the coat check area does so entirely at their own risk and responsibility and may be charged for the costs of their removal, including the costs incurred by the relevant services.
Anyone using the coat check must retrieve any outerwear or other items left there before leaving the Pavilion.
Items left in the coat check and not claimed will be deposited, along with a report from the relevant committee, in the storage room after the event/performance ends. From there, after prior notification sent to the email address: kontakt@pawilontanca.pl and confirmation by a Cloakroom staff member, they may be collected by the person who reported leaving their property, but no later than 14 days from the date they were left. After this period, the items referred to in the preceding sentence will be disposed of by a committee.
§ 6
Items are accepted at the coat check by physically handing them over to the coat check staff.
When accepting items at the coat check, the coat check staff is required to issue a ticket. At some events organized by Pawilon, the coat check may be self-service.
The receipt serves as proof of acceptance of the item for safekeeping.
Subject to paragraph 6, items are released from the coat check upon presentation of the ticket.
In the event that a ticket is lost or damaged and the owner requests the return of the stored items, the cloakroom attendant is required to:
notify the Pavilion employee on duty of the incident;
determining the characteristics of the item by speaking with the person requesting its return;
release of the item following a positive verification of the contents of the hanger or the surveillance footage;
prepare a report on the release of an item without returning the tag, including, in particular, a description of the conversation, the item’s identifying characteristics, the time of release, and the personal information of the Pavilion employee on duty (first and last name, contact phone number), the security guard (first and last name), and the person requesting the release of the item (first and last name, contact phone number), including information about the documents confirming their identity.
If a person without a ticket number is unable to clearly describe an item left in the coat check, that item may be retrieved only after the event has ended and the report described in paragraph 5(d)(p) has been prepared, in the presence of an authorized employee.
The person operating the coat check is not required to verify that the person handing over items for storage is the same person who requests their return based on the issued receipt number.
§ 7
The locker room attendant is responsible for items left in the locker room.
The cloakroom staff is required to exercise due diligence
in the storage of entrusted items.
The Pavilion assumes no responsibility for items left on the Pavilion grounds outside the Cloakroom.
§ 8
Everyone using the Locker Room is required to read the above Rules and Regulations and to comply with them.
The Pavilion assumes no liability for failure to comply with these Rules and Regulations. Use of the coat check constitutes acceptance of the terms and conditions set forth in these Rules and Regulations.
The current version of the Rules and Regulations is available in the Pavilion’s locker room and on the Pavilion’s website.
The Pavilion reserves the right to amend these Rules and Regulations. Any amendment takes effect upon its adoption, which will be announced by posting the new version of the Rules and Regulations in the Locker Room and publishing it on the Pavilion’s website.

For matters not covered by these Rules, the provisions of the Civil Code shall apply.
Information regarding the processing of personal data—to the extent that such processing is necessary to exercise the rights or fulfill the obligations set forth in these Terms and Conditions—is provided in the privacy notice attached as an appendix to these Terms and Conditions.
These Terms and Conditions take effect on January 7, 2026.

Your personal data is processed pursuant to Article 6(1)(f) of the GDPR, which means that the processing is necessary for purposes arising from the legitimate interests pursued by the Data Controller or by a third party, namely:
a. for the purpose of retrieving items left behind and not claimed at the coat check, in accordance with § 3(5) of the Rules for Using the Art Museum's Cloakroom Modern Party in Warsaw during the event “The Last New Year’s Eve over "Wisła" from 8:00 p.m. on December 31, 2023, to 7:00 a.m. on January 1, 2024 (hereinafter referred to as the “Lockers Usage Rules”) or b. to retrieve items from the coat check in the event that the ticket is lost, in accordance with § 4, paragraphs 5 and 6, of the Locker Room Rules and Regulations, c. for the purpose of establishing, pursuing, and defending claims related to use of the locker room.
Providing personal information is voluntary, but necessary for communicating with the Museum or for completing the receipt form when picking up items from the coat check.
The recipients of your personal data may include: entities providing email hosting services and other IT service providers; the Museum’s contractors to whom it has outsourced all or part of the services related to coat check operations, including personnel providing visitor services/coat check services, security staff, entities providing accounting, auditing, or consulting services, including legal and tax services.
Your personal data will be processed by the Museum until any claims arising from the use of the coat check expire.
You have the right to: request access to the personal data you have provided,
the right to correct personal data, the right to request the deletion of personal data, as well as Restrictions on the processing of personal data.
You also have the right to object to the processing of your personal data on the basis of your particular situation; however, this does not apply to the processing of personal data for the purpose of establishing, exercising, or defending legal claims.
You also have the right to file a complaint with the supervisory authority, which in Poland is the President of the Office for Personal Data Protection (ul. Stawki 2, 00-193 Warsaw).
No automated decisions will be made regarding the personal data provided, including decisions based on profiling.
