RULES FOR PARTICIPATION IN EVENTS
Rules for Participation in Events Held at the Pavilion of Dance and Other Performing Arts, located in Warsaw at 22 Wybrzeże Kościuszkowskie Street
The Rules for Participation in Events Held at the Pavilion of Dance and Other Performing Arts (“Rules”) set forth the guidelines for the participation of third parties (i.e., audience members and guests of the Pavilion of Dance and Other Performing Arts) in events organized by the Pavilion of Dance and Other Performing Arts (hereinafter: “the Pavilion”).
§ 1
The Pavilion reserves the right to make changes to the program; in such cases, holders of valid tickets are entitled to a refund of the ticket price or to reschedule the event they intended to attend.
§ 2
To receive a refund for tickets, you must present the ticket along with the original receipt. Refunds are available up to 72 hours before the event.
§ 3
By purchasing a ticket and/or voucher or picking up a free admission pass, you agree to the rules for participating in events held at the Pavilion. 
§ 4
A purchased ticket or a downloaded free admission pass serves as proof of eligibility to enter the event and will be verified upon entry.
§ 5
Attendees of performances and other events held at the Pavilion are asked to arrive early.
§ 6
The Pavilion reserves the right to deny admission to the Event to any latecomer. Whenever possible, latecomers will be admitted to the auditorium; however, the Pavilion does not guarantee that the latecomer will be seated in the seat indicated on their ticket. Latecomers will be asked to take any available seat designated by the Pavilion’s audience services staff.
§ 7
During performances, photography, videography, audio recording, and the use of devices that emit sound and/or light are prohibited. In particular, audience members are asked to turn off their phones or set them to airplane mode.
§ 8
In certain cases, the event organizer may grant participants permission to take photographs, film, and record audio. This applies in particular to events and workshops, provided that the person leading them has given their consent.
§ 9
Eating and drinking (with the exception of water) are strictly prohibited in the auditorium, particularly alcoholic beverages.
§ 10
In exceptional cases, the event organizer may grant participants permission to consume beverages, including alcoholic beverages, in the auditorium where the event is taking place.
§ 11
Spectators may purchase and consume beverages, including low-alcohol drinks, exclusively at the bar located in the Pavilion. 
§ 12
In the interest of the safety and comfort of all participants and the smooth running of the event, participants are required to behave in a manner consistent with the norms of social conduct, and in particular, not to disturb other attendees in the room. 
§ 13
The organizer reserves the right to refuse entry to or remove from the Pavilion building any persons under the influence of alcohol or intoxicating substances who behave in a manner that disrupts the proper conduct of events on the Pavilion premises.
§ 14
Participants take part in the events at their own risk and responsibility. The organizer shall not be liable for any personal injury or property damage, unless otherwise required by mandatory provisions of law. The organizer does not provide medical care or accident insurance for participants.
§ 15
The Organizer does not provide supervision for minors. Minors may participate in events only under the supervision of their legal guardians or other authorized persons, or with their written consent given in the presence of the Organizer. 
§ 16
Liability for any injury to a minor or damage to the minor’s property rests with the minor’s legal guardian, unless mandatory provisions of law provide otherwise.
§ 17
The organizer is not responsible for any items brought by participants.
§ 18
For outdoor events, participants are required to dress appropriately for the weather conditions. The organizer will decide whether to proceed with, cancel, or reschedule the event in the event of adverse weather conditions.
§ 19
In the event of a change in weather conditions during the event, the Organizer reserves the right to cancel the event.

In accordance with the General Data Protection Regulation (GDPR) regarding the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC, we hereby inform you that:
  1. The controller of your personal data is the Museum of Modern Art in Warsaw, located at ul. Pańska 3, 00-124 Warsaw, entered in the register of cultural institutions of the Capital City of Warsaw under No. RIK/1/2023, REGON: 140187435, NIP: 525-234-18-32 (hereinafter also referred to as the “Controller” or “Museum”).

  6. Your personal data will be processed in connection with the organization and implementation of the program offered by the Warsaw Museum of Modern Art – Pavilion on the Vistula (Pavilion of Dance and Other Performing Arts).

The legal basis for the processing of your personal data is Article 6(1)(f) of the GDPR, which means that the processing is necessary for the purposes of the legitimate interests pursued by the Museum as the data controller or by a third party, including the organization and conduct of the event and enabling participants to take part
  8. in connection with this event, as well as the identification, investigation, and defense against any potential claims. 
  9. The basis for processing personal data may also be:
  10. - Article 6(1)(a) of the GDPR, which means that you have consented to the processing of your personal data for a specific purpose; this may apply in particular to the processing of personal data in the form of images in connection with the documentation of an event through photographs and/or recordings (Article 81(1) of the Act on Copyright and Related Rights),
  11. - Article 6(1)(c) of the GDPR, which means that the processing of data is necessary for the Museum, as the data controller, to comply with a legal obligation related to the fulfillment of tax obligations.
  12. As a general rule, the museum collects personal data directly from event participants who register for the event. Data may also be obtained from persons other than the data subject—in particular, from a person or entity that submits the registration, including on behalf of the event participant.
  13. Providing personal information is voluntary, but required to participate
  14. in the event. Failure to provide this information may result in your inability to participate in the event. 
  15. The recipients of your personal data may include, in particular, entities providing email hosting services, other entities providing IT services, entities providing property security services, entities providing consulting services—including legal, tax, and other services— other contractors of the Museum, as well as entities to whom your data is disclosed in connection with the performance of legal relationships between them and the Museum or
  16. in connection with the Museum’s activities, primarily if such sharing is related to the organization of an event, external entities that organize or co-organize events. Photographic and video documentation of the event may also be made available on the Museum’s website and social media to an unlimited audience.
  17. Your personal data will be processed by the Museum for the duration of the event. Personal data may also be processed thereafter if necessary to establish, pursue, or defend legal claims, or, if necessary, for the duration of the retention period for tax purposes (whichever period is longer).
  18. In the case of personal data processed on the basis of consent, such data may be processed for the duration of the data retention period for the event, which may be up to 10 years.  
  19. You have the right to request access to the personal data you have provided, to have it corrected, to request its deletion, and to request that its processing be restricted. 
  20. You have the right to object to the processing of your personal data on grounds relating to your particular situation. 
  21. If your data is processed based on your consent, you have the right to withdraw your consent at any time, without affecting the lawfulness of
  22. with regard to processing carried out on the basis of consent prior to its withdrawal. 
  23. You also have the right to file a complaint with the supervisory authority, which is the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw).
  24. No decisions regarding the personal data provided will be made automatically, including through profiling.
